Terms of Service
Terms governing use of the Mendify platform, therapy bookings, payments, accounts, and institutional wellness programmes.
These Terms of Service (“Terms”) govern your access to and use of Mendify websites, booking tools, accounts, and related services (collectively, the “Platform”). Mendify connects users with independent licensed mental health professionals and clinic services. By using the Platform, you agree to these Terms and our Privacy Policy.
1. About Mendify
Mendify provides a technology platform for discovering therapists, booking sessions, making payments, and managing care logistics. Unless expressly stated, Mendify does not provide therapy itself; licensed professionals deliver clinical services under their own professional obligations and scope of practice.
2. Eligibility
You must be legally able to enter into a binding agreement to use the Platform. If you book services for a minor or on behalf of another person, you represent that you have authority to do so.
3. Accounts and security
- You are responsible for maintaining the confidentiality of your login credentials
- You agree to provide accurate, current information
- You must notify us promptly of unauthorised account use
- We may suspend or terminate accounts that violate these Terms or create risk to users or the Platform
4. Booking and sessions
- Session availability is shown in real time where possible but is not guaranteed until booking is confirmed
- You are responsible for attending sessions on time and using secure devices and networks for online care
- Session links, clinic directions, and reminders are provided for convenience and may depend on third-party systems
- Therapists may have their own attendance, documentation, and clinical policies within applicable law
5. Fees, payments, and wallet credits
Fees are displayed during booking. Payments are processed through approved payment partners. Mendify may offer wallet credits or promotional balances subject to separate rules. Taxes, if applicable, will be shown or communicated as required. Failed or disputed payments may result in booking cancellation as described in our Cancellation & Refund Policy.
6. Cancellations and rescheduling
Cancellation windows, reschedule rules, and refund outcomes depend on session timing, therapist policy, and Platform settings in effect at the time of booking. Please review our Cancellation & Refund Policy before booking.
7. Acceptable use
You agree not to:
- Use the Platform for unlawful, abusive, or fraudulent purposes
- Harass therapists, staff, or other users
- Attempt to bypass payments, access controls, or security measures
- Scrape, reverse engineer, or misuse Platform content or data
- Upload malware or interfere with Platform operations
- Misrepresent your identity or clinical needs in a harmful way
8. Institutional and corporate programmes
Organisations using Mendify workplace programmes enter into separate commercial arrangements. Employee utilisation reporting is provided in anonymised form unless otherwise agreed. Business contacts must not submit employee health information through corporate enquiry forms.
9. Intellectual property
Mendify branding, website content, software, and design elements are owned by Mendify or its licensors. You may not copy, modify, or distribute Platform materials except as permitted by law or with our written consent.
10. Third-party services
The Platform may integrate payment gateways, video conferencing, maps, and other third-party tools. Your use of those services may be subject to their terms. Mendify is not responsible for third-party outages beyond our reasonable control.
11. Disclaimers
The Platform is provided on an “as available” basis. Mendify does not guarantee uninterrupted access, specific clinical outcomes, or suitability of every therapist match. Clinical content on the website is informational and not a substitute for professional assessment. See our Medical Disclaimer.
12. Limitation of liability
To the fullest extent permitted by law, Mendify and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform. Our aggregate liability for claims relating to the Platform will not exceed the amount you paid to Mendify for the booking giving rise to the claim during the three months preceding the event, except where liability cannot be limited by law.
13. Indemnity
You agree to indemnify Mendify against claims arising from your misuse of the Platform, violation of these Terms, or infringement of third-party rights, except to the extent caused by Mendify’s own negligence or misconduct.
14. Governing law
These Terms are governed by the laws of India. Courts in Kerala, India shall have exclusive jurisdiction, subject to mandatory consumer protections that may apply to you.
15. Changes
We may update these Terms from time to time. Updated Terms will be posted on this page. Material changes may also be communicated through the Platform or by email where appropriate.
